١. من نحن وما هي هذه الوثيقة

«تشافي» (المشار إليه فيما يلي بـ«تشافي» أو «المنصّة» أو «نحن») هو دليل معلوماتي لمقدّمي الرعاية الصحية في سوريا — الأطباء والمشافي والعيادات والصيدليات والمخابر — يهدف إلى مساعدة المستخدمين على العثور على مقدّم الرعاية والتواصل معه. تُقدَّم المنصّة عبر الموقع والتطبيق والخدمات المرتبطة بهما (يُشار إليها مجتمعةً بـ«الخدمة»).

تحكم شروط الاستخدام هذه («الشروط») وصولك إلى الخدمة واستخدامك لها. باستخدامك للخدمة فإنك توافق على هذه الشروط. إذا كنت لا توافق عليها، فيرجى عدم استخدام الخدمة.

هذه الشروط اتفاقٌ بينك وبين الجهة القانونية المشغّلة لتشافي: [اسم الكيان القانوني وبلد التسجيل — يحدّده المستشار القانوني].

٢. تشافي دليلٌ معلوماتي — ولا يقدّم رعاية أو مشورة طبية

هذا القسم جوهري، ويرجى قراءته بعناية:

تشافي دليل معلوماتي فقط. نحن نعرض معلومات مهنية عن مقدّمي الرعاية ونيسّر التواصل معهم. نحن لا نمارس الطبّ، ولا نقدّم استشارات أو تشخيصات أو علاجات أو أي مشورة طبية، ولا نوصي بمقدّم رعاية بعينه على أنه «الأفضل» لحالتك.
لا تنشأ أي علاقة طبيب–مريض بينك وبين تشافي عبر استخدامك للخدمة. أي علاقة رعاية صحية تنشأ حصراً بينك وبين مقدّم الرعاية الذي تختاره، وتكون مستقلّة تماماً عن تشافي.
قراراتك الصحية مسؤوليتك بالتشاور مع مختصّ مؤهّل. لا تُعدّ المعلومات المعروضة على تشافي بديلاً عن الاستشارة الطبية المباشرة. استشر دائماً طبيباً أو صيدلياً مرخّصاً بشأن حالتك الصحية.
نحن نصل، والأطباء يعالجون. دور تشافي ينتهي عند مساعدتك على إيجاد مقدّم الرعاية والوصول إلى بيانات التواصل معه.

٣. حالات الطوارئ — لا تعتمد على البحث

في حالة الطوارئ الطبية، اتصل فوراً بالإسعاف على الرقم ١١٠، أو توجّه إلى أقرب قسم طوارئ.

الخدمة ليست أداة استجابة للطوارئ. لا تستخدم البحث في تشافي، ولا تنتظر ردّ أي مقدّم رعاية عبر المنصّة، في أي وضع طارئ أو يهدّد الحياة. قد تكون بيانات التواصل أو ساعات العمل المعروضة غير محدَّثة أو غير دقيقة، وقد لا يكون مقدّم الرعاية متاحاً. عند وجود شكّ، اتصل بالرقم ١١٠ أو اذهب مباشرةً إلى أقرب مشفى.

٤. معنى شارة «موثّق» وحدودها

شارة «موثّق» هي أهمّ ما نقدّمه، ونحن نحرص عليها. وإلى جانبها توجد حالات: «غير موثّق» (بيانات مُدرجة لم يجرِ التحقق منها بعد) و**«قيد التوثيق»** (طلبٌ مقدَّم تحت المراجعة).

ما تعنيه شارة «موثّق» في لحظة إجراء التحقق:

أننا تحقّقنا — ببذل جهد معقول — من أن الشخص أو المنشأة موجود ومرخَّص (فحص الاعتماد المهني)؛
وأنه يزاول عمله فعلاً في الموقع المُدرج (فحص النشاط)؛
وأن هذا التحقق جرى في تاريخ معلن يظهر على الملف («تاريخ آخر توثيق»).

حدود الشارة — يرجى الانتباه:

التوثيق تحقّقٌ ببذل عناية معقولة في لحظة زمنية، وليس ضماناً مستمراً. قد تتغيّر الظروف بعد تاريخ التوثيق (يتوقف مقدّم الرعاية عن المزاولة، يغيّر عنوانه أو رقمه، تُسحب رخصته). نعيد التحقق دورياً (كل ستة أشهر تقريباً)، لكننا لا نضمن أن كل معلومة محدَّثة في كل لحظة.
الشارة ليست تقييماً لجودة الرعاية. التوثيق يعني وجود الاعتماد المهني والمزاولة الفعلية — وهو لا يعني أن تشافي يقيّم أو يضمن مهارة مقدّم الرعاية أو جودة علاجه أو مخرجاته أو ملاءمته لحالتك.
الشارة لا تُباع أبداً. لا يمكن لأي مقدّم رعاية شراء التوثيق أو الحصول عليه بالدفع؛ فهو ناتج عن فحص فعلي فقط. أما خدمات الظهور المميّز/الإبراز المدفوعة فمنفصلة تماماً عن التوثيق ولا تؤثر في نتيجته.
علامة «بيانات تجريبية». قد تظهر أثناء مرحلة التطوير سجلّات توضيحية موسومة بـ«بيانات تجريبية»؛ وهي ليست مقدّمي رعاية حقيقيين ولا يجوز الاعتماد عليها إطلاقاً.

٥. الاستخدام المقبول للمستخدمين (الباحثين عن الرعاية)

بوصفك مستخدماً للخدمة، فإنك توافق على ما يلي:

أن تستخدم الخدمة لغرضها المشروع: العثور على مقدّم رعاية والتواصل معه لأغراضك الشخصية أو العائلية.
ألّا تنسخ أو تستخرج أو تجمّع بيانات الدليل بشكل آلي (كالكشط أو السحب الجماعي) أو تعيد نشرها أو تبيعها دون إذن خطّي مسبق منّا.
ألّا تستخدم بيانات التواصل الظاهرة على المنصّة لإرسال دعاية أو رسائل مزعجة أو محتوى مسيء إلى مقدّمي الرعاية.
أن تقدّم — عند إرسال طلب «تصحيح معلومة» أو «المطالبة بملفّي» — معلومات صحيحة وحسنة النيّة، وألّا تنتحل صفة غيرك أو تقدّم بلاغات كيدية عن مقدّمي رعاية لا تربطك بهم علاقة.
ألّا تحاول الإضرار بالخدمة أو تعطيلها أو اختراقها أو الوصول غير المصرَّح به إلى أي جزء منها.
أن تتحمّل مسؤولية التحقّق مباشرةً من بيانات مقدّم الرعاية (الترخيص، الاختصاص، ساعات العمل، الرسوم) قبل بناء أي قرار مهم عليها.

٦. التزامات مقدّمي الرعاية

إذا كنت مقدّم رعاية أو تتصرّف نيابةً عنه (بالمطالبة بملفّ، أو التسجيل، أو الاشتراك في خدمة مدفوعة)، فإنك تُقرّ وتوافق على ما يلي:

صحّة المعلومات. أن تكون جميع المعلومات التي تقدّمها — الاسم، الاختصاص، الترخيص، العنوان، أرقام التواصل، ساعات العمل، نطاق الرسوم — صحيحة ودقيقة ومحدَّثة، وأن تسارع إلى تصحيح أي بيان يصبح غير دقيق.
صفة التمثيل. أن تكون مقدّم الرعاية نفسه أو مخوَّلاً بالتصرف نيابةً عنه وتمثيل تلك المزاولة. المطالبة بملفّ لا تملك حقّ تمثيله (كأن يطالب منافس بملفّ زميل له) محظورة وتُعدّ خرقاً لهذه الشروط.
منع انتحال الصفة والاحتيال. يُحظر انتحال صفة مقدّم رعاية آخر، أو تقديم اعتمادات مزوّرة، أو تضخيم الألقاب (مثل «استشاري» بدل «أخصائي») خلافاً لما تثبته وثائقك.
التعاون في التحقق. أنك تفهم أن التوثيق يقتضي إجراءات تحقق (كمكالمة فيديو، ورقم لمرّة واحدة عبر واتساب، وتأكيد الرخصة والعنوان، وربما زيارة ميدانية)، وأنك توافق على التعاون بصدق. علماً أن الوثائق التي تقدّمها للتحقق تُستخدم كأدلّة داخلية فقط ولا تُنشر.
الترخيص القانوني للمزاولة. أنك مرخَّص ومؤهَّل قانوناً لتقديم الخدمات التي تعرضها، وأنك مسؤول وحدك عن الالتزام بجميع القوانين واللوائح المهنية والنقابية المطبّقة عليك.
الخدمات المدفوعة. أن خدمات الإبراز أو الظهور المميّز المدفوعة تخضع لشروط تجارية منفصلة، وأنها لا تشتري توثيقاً ولا تؤثر في نتيجة التحقق، وأن تشافي يحتفظ بحقّه في رفض أو إيقاف أي إدراج مخالف لهذه الشروط دون ردّ المبالغ إن وُجد احتيال أو انتحال.

٧. الملكية الفكرية

جميع عناصر المنصّة — الاسم والعلامة «تشافي/تشافي»، والشعار، والتصميم، والبرمجيات، والنصوص، وبنية الدليل، وتجميع البيانات — مملوكة لتشافي أو مرخَّصة له، ومحميّة بموجب قوانين الملكية الفكرية. [يؤكّد نطاق الحماية المستشار القانوني]
تُمنح للمستخدم رخصةٌ محدودة وشخصية وغير حصرية وقابلة للإلغاء لاستخدام الخدمة وفق هذه الشروط. لا يُنقل إليك أي حقّ آخر.
تظلّ بيانات مقدّم الرعاية ذات الطابع المهني/العام (الاسم، الاختصاص، العنوان، الهاتف) خاضعةً لسياساتنا؛ ويحقّ لمقدّم الرعاية المطالبة بملفّه أو تصحيحه أو طلب إزالته وفق القسم ٩ وسياسة الخصوصية.
المحتوى الذي تقدّمه إلينا (كتصحيح معلومة أو نصّ ملفّ) تمنحنا بشأنه رخصةً لعرضه ضمن الخدمة وتشغيلها وتحسينها.

٨. إخلاء المسؤولية وحدود المسؤولية القانونية

تُقدَّم الخدمة «كما هي» و«حسبما تتوفّر». لا نقدّم أي ضمانات صريحة أو ضمنية بشأن دقّة بيانات الدليل أو اكتمالها أو حداثتها أو ملاءمتها لغرض معيّن، ولا بشأن توفّر الخدمة دون انقطاع أو خلوّها من الأخطاء.
لا نضمن نتائج الرعاية. لا يتحمّل تشافي أي مسؤولية عن أفعال مقدّمي الرعاية أو تقصيرهم، ولا عن جودة أي رعاية أو تشخيص أو علاج أو نصيحة تتلقّاها منهم؛ فهذه علاقة مباشرة بينك وبين مقدّم الرعاية.
إلى الحدّ الأقصى الذي يسمح به القانون المطبّق، لا يكون تشافي ولا مسؤولوه ولا موظفوه ولا وكلاؤه مسؤولين عن أي أضرار غير مباشرة أو تبعية أو عرضية أو تأديبية، أو عن أي خسارة ناجمة عن اعتمادك على معلومات الدليل، أو عن تعاملك مع مقدّم رعاية، أو عن عدم توفّر الخدمة. [يحدّد المستشار القانوني الحدّ الأقصى للمسؤولية وأي استثناءات إلزامية بحسب القانون المطبّق]
الطوارئ. يخلي تشافي مسؤوليته صراحةً عن أي اعتماد على الخدمة في حالات الطوارئ؛ راجع القسم ٣.
لا يقيّد أيّ ممّا سبق أيّ مسؤولية لا يجوز قانوناً استبعادها أو تقييدها.

٩. تعليق الإدراجات وإزالتها

يحقّ لتشافي — بتقديره المعقول — تعليق أو تعديل أو إزالة أي إدراج أو حساب أو محتوى يخالف هذه الشروط، أو يتبيّن أنه غير دقيق أو احتيالي أو منتحِل، أو تلزمنا إزالته قانوناً.
عند ثبوت محاولة انتحال أو احتيال، قد نلغي تفعيل الملفّ ونحتفظ بسجلّ داخلي بذلك، اتساقاً مع إجراءات مكافحة الاحتيال لدينا.
يحقّ لمقدّم الرعاية طلب تصحيح ملفّه أو إزالته؛ وننظر في هذه الطلبات وفق سياسة التحقق والخصوصية لدينا. كما يحقّ لأي مستخدم الإبلاغ عن معلومة خاطئة عبر روابط المنصّة.
قد نوقف أو ننهي وصول أي مستخدم يخالف هذه الشروط، مع الاحتفاظ بأي حقوق أخرى يكفلها القانون.

١٠. تعديل الشروط والخدمة

قد نحدّث هذه الشروط من وقتٍ لآخر. عند إجراء تغيير جوهري نحدّث تاريخ «آخر تحديث» أعلاه، وقد ننبّه إليه داخل الخدمة عند الاقتضاء. استمرارك في استخدام الخدمة بعد سريان التعديل يعني قبولك له. كما يحقّ لنا تعديل الخدمة أو إيقاف أجزاء منها.

١١. القانون الحاكم وتسوية النزاعات

تخضع هذه الشروط وتُفسَّر وفق قانون: [يحدّده المستشار القانوني — يُتوقّع القانون السوري لعمليات التشغيل، مع مراعاة قانون بلد تسجيل الكيان لأغراض المدفوعات والملكية الفكرية]. وتختصّ بأي نزاع ناشئ عنها المحاكم/آلية التسوية التالية: [يحدّدها المستشار القانوني].

١٢. أحكام عامة

إذا تبيّن بطلان أو عدم نفاذ أيّ بندٍ من هذه الشروط، يبقى سائر البنود نافذاً.
عدم ممارستنا لأي حقّ لا يُعدّ تنازلاً عنه.
تمثّل هذه الشروط — مع سياسة الخصوصية وأي شروط تجارية للخدمات المدفوعة — الاتفاق الكامل بينك وبيننا بشأن الخدمة.

1. Who we are and what this document is

"Tashafi" (referred to here as "Tashafi," "the Platform," or "we") is an informational directory of healthcare providers in Syria — doctors, hospitals, clinics, pharmacies, and labs — designed to help users find and contact a provider. The Platform is delivered through our website, app, and related services (together, the "Service").

These Terms of Service (the "Terms") govern your access to and use of the Service. By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

These Terms are an agreement between you and the legal entity that operates Tashafi: [legal entity name and country of registration — to be set by counsel].

2. Tashafi is an informational directory — it does not provide care or medical advice

This section is essential; please read it carefully:

Tashafi is an informational directory only. We display professional information about providers and make it easier to contact them. We do not practice medicine, and we do not provide consultations, diagnoses, treatment, or any medical advice, nor do we recommend any particular provider as "best" for your condition.
No doctor-patient relationship is created between you and Tashafi through your use of the Service. Any healthcare relationship arises solely between you and the provider you choose, entirely independently of Tashafi.
Your health decisions are your responsibility, made in consultation with a qualified professional. Information shown on Tashafi is not a substitute for direct medical consultation. Always consult a licensed doctor or pharmacist about your health.
We connect; doctors treat. Tashafi's role ends at helping you find a provider and reach their contact details.

3. Emergencies — do not rely on search

In a medical emergency, immediately call the ambulance on 110, or go to the nearest emergency department.

The Service is not an emergency-response tool. Do not use search on Tashafi, and do not wait for any provider to respond through the Platform, in any emergency or life-threatening situation. Contact details or hours shown may be out of date or inaccurate, and a provider may be unavailable. When in doubt, call 110 or go straight to the nearest hospital.

4. What the "verified/موثّق" badge means and its limits

The "verified" (موثّق) badge is the most important thing we offer, and we guard it. Alongside it there are the states "unverified" (غير موثّق) (listed data not yet checked) and "in verification" (قيد التوثيق) (a submitted request under review).

What the "verified" badge means, at the moment the check was performed:

that we have checked — using reasonable effort — that the person or facility exists and is licensed (credential check);
that they are actually practicing at the listed location (activity check);
that this check happened on a stated date shown on the profile ("last verified" date).

Limits of the badge — please note:

Verification is a reasonable, best-effort check at a point in time, not a continuing guarantee. Circumstances may change after the verification date (a provider stops practicing, changes address or number, loses their license). We re-verify periodically (roughly every six months), but we do not guarantee that every piece of information is current at all times.
The badge is not a rating of quality of care. Verification means the professional credential and active practice were confirmed — it does not mean Tashafi rates or guarantees a provider's skill, quality of treatment, outcomes, or suitability for your condition.
The badge is never sold. No provider can buy verification or obtain it by payment; it results only from an actual check. Paid featured placement / promotion services are entirely separate from verification and do not influence its outcome.
"Demo data" label. During development, illustrative records labeled "بيانات تجريبية" (demo data) may appear; these are not real providers and must never be relied upon.

5. Acceptable use for patients (people seeking care)

As a user of the Service, you agree that you will:

Use the Service for its legitimate purpose: finding and contacting a provider for your personal or family needs.
Not copy, extract, or automatically harvest directory data (e.g., scraping or bulk pulling), nor republish or sell it, without our prior written permission.
Not use contact details shown on the Platform to send advertising, spam, or abusive content to providers.
When submitting a "report wrong info" or "claim my profile" request, provide truthful, good-faith information, and not impersonate anyone or file malicious reports about providers with whom you have no connection.
Not attempt to harm, disrupt, hack, or gain unauthorized access to any part of the Service.
Take responsibility for verifying provider details directly (license, specialty, hours, fees) before basing any important decision on them.

6. Provider obligations

If you are a provider or act on a provider's behalf (by claiming a profile, registering, or subscribing to a paid service), you represent and agree that:

Accurate information. All information you provide — name, specialty, license, address, contact numbers, hours, fee range — is true, accurate, and up to date, and you will promptly correct anything that becomes inaccurate.
Right to represent. You are the provider yourself or authorized to act on their behalf and represent that practice. Claiming a profile you have no right to represent (e.g., a competitor claiming a colleague's profile) is prohibited and is a breach of these Terms.
No impersonation or fraud. Impersonating another provider, submitting falsified credentials, or inflating titles (e.g., "استشاري/consultant" instead of "أخصائي/specialist") contrary to your documents is prohibited.
Cooperation with verification. You understand that verification involves checks (such as a video call, a one-time code via WhatsApp, confirmation of license and address, and possibly a field visit), and you agree to cooperate honestly. Documents you provide for verification are used as internal evidence only and are not published.
Legal authorization to practice. You are legally licensed and qualified to provide the services you list, and you are solely responsible for complying with all professional, regulatory, and syndicate laws applicable to you.
Paid services. Paid promotion or featured-placement services are governed by separate commercial terms; they do not buy verification and do not affect the outcome of a check, and Tashafi reserves the right to refuse or suspend any listing that breaches these Terms, without refund where fraud or impersonation is found.

7. Intellectual property

All elements of the Platform — the "Tashafi/تشافي" name and mark, the logo, the design, the software, the text, the directory structure, and the data compilation — are owned by or licensed to Tashafi and protected under intellectual-property law. [scope of protection to be confirmed by counsel]
You are granted a limited, personal, non-exclusive, revocable license to use the Service in accordance with these Terms. No other rights are transferred to you.
Providers' professional/public-record data (name, specialty, address, phone) remains subject to our policies; a provider may claim, correct, or request removal of their profile under Section 9 and the Privacy Policy.
For content you submit to us (such as a correction or profile text), you grant us a license to display it within, operate, and improve the Service.

8. Disclaimers and limitation of liability

The Service is provided "as is" and "as available." We make no express or implied warranties as to the accuracy, completeness, currency, or fitness for a particular purpose of directory data, nor that the Service will be uninterrupted or error-free.
We do not guarantee care outcomes. Tashafi bears no responsibility for the acts or omissions of providers, or for the quality of any care, diagnosis, treatment, or advice you receive from them; that is a direct relationship between you and the provider.
To the maximum extent permitted by applicable law, neither Tashafi nor its officers, employees, or agents shall be liable for any indirect, consequential, incidental, or punitive damages, or for any loss arising from your reliance on directory information, your dealings with a provider, or the unavailability of the Service. Emergencies. Tashafi expressly disclaims liability for any reliance on the Service in an emergency; see Section 3.
Nothing above limits any liability that cannot lawfully be excluded or limited.

9. Suspension and removal of listings

Tashafi may, at its reasonable discretion, suspend, modify, or remove any listing, account, or content that breaches these Terms, is found to be inaccurate, fraudulent, or impersonating, or that we are legally required to remove.
Where an impersonation or fraud attempt is established, we may deactivate the profile and keep an internal record, consistent with our anti-fraud procedures.
A provider may request correction or removal of their profile; we handle such requests under our verification and privacy policies. Any user may also report wrong information via the Platform's links.
We may suspend or terminate access for any user who breaches these Terms, while retaining any other rights available at law.

10. Changes to the Terms and the Service

We may update these Terms from time to time. When we make a material change, we will update the "Last updated" date above and may notify you within the Service where appropriate. Continued use of the Service after a change takes effect means you accept it. We may also modify the Service or discontinue parts of it.

11. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the law of: [to be set by counsel — Syrian law is expected for operations, with the law of the entity's country of registration relevant for payments and IP]. 12. General provisions

These Terms — together with the Privacy Policy and any commercial terms for paid services — constitute the entire agreement between you and us regarding the Service.
